1. Acceptance of Terms

By accessing or using FlowGate ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not use the Service.

2. Description of Service

FlowGate is an AI-powered sales orchestration platform for event organizers. The Service includes revenue analytics, AI-driven marketing, sales optimization (IQO), entry-by-intent tracking, revenue rules engine, and related features.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must be at least 18 years old to create an account.

4. Subscription Plans & Payments

• Starter: €19.99/month — 10 active events, Revenue OS, AI Sales Analyst, IQO, CSV/API import.
• Pro: €49.99/month — 50 active events, all Starter features, AI Marketing, Entry by Intent, Rules Engine, NL Commands, API keys.
• Business: €79.99/month — Unlimited events, all Pro features, multi-user RBAC, custom integrations, dedicated support.

All payments are processed securely through Stripe. Subscriptions are billed monthly and renew automatically. You may cancel at any time; cancellation takes effect at the end of the current billing period.

5. Free Trial

New accounts receive a free trial with limited functionality (3 events). No credit card is required for the trial.

6. Refund Policy

We offer a 14-day refund policy from the date of your first payment. If you are not satisfied with the Service, contact us at [email protected] within 14 days for a full refund.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to other users' accounts or data.
• Use the API in a way that could impair the Service's performance or availability.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Resell or redistribute the Service without our written permission.

8. Intellectual Property

The Service, including its design, code, AI models integration, and branding, is owned by FlowGate. You retain ownership of all data you upload to the platform. By using the Service, you grant us a limited license to process your data as necessary to provide the Service.

9. AI-Generated Content

FlowGate uses AI (Claude by Anthropic) to generate marketing content, sales recommendations, and analytics insights. AI-generated content is provided as suggestions only. You are responsible for reviewing and approving any AI-generated content before use. We do not guarantee the accuracy or effectiveness of AI-generated content.

10. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

11. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability. We are not liable for any downtime or service interruptions.

12. Limitation of Liability

To the maximum extent permitted by law, FlowGate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

13. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data in accordance with our Privacy Policy.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or through the platform. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union. Any disputes shall be resolved in the competent courts.
